Taxpayer Advocate Needed
When I computed my taxes in 2006, I had a whopping tax bill, which I dutifully paid. Later I got a corrected W2C from my employer, it turns out that my withholdings were underreported and I filed an amended 1040X tax return, I was to due most of this back. Knowing that I was on track to owe in 2007, I simply opted to have the money applied to my 2007 tax payment, in lieu of paying an estimated tax payment. Big mistake. One that I will never repeat.
In June of 2008, I got a notice that the payment had not been applied. I made a phone call to the number indicated, and was told that the payment was likely delayed due to the tax incentive rebate checks, and was assured that there was nothing I could or needed to do.
I also got notice of an under-reporting issue. This was my mistake, and actually turned out to be in my favor to the tune of $140 dollars. By July, another phone call, and I was assured that was resolved.
In October, I got notices on both of my 2006 and 2007 tax returns, with additional taxes and penalties. Another phone call, and this time I took notes of people’s names and numbers. The person was helpful as one could expect given that she neither had access to my 1040X, nor could she give me the phone number of someone who did. She indicated that my 2006 1040X was “closed”, with no funds being applied to my 2007 account, and could not explain why that might be. She put in a request on my behalf that I be contacted “within 30 days”, and a 9 week hold was placed on the collection of my 2007 account. I also was asked to send a full account to the Office of D Kidd, which I dutifully did.
In November, I got a notice that the full amount of my 2006 return was due to me, including the $140. I hoped that the amount would still be applied to my 2007 return, but feared that the amount would be sent to me. If only I had been so lucky.
In February, I got again got notice on my 2007 tax return, and I made another phone call. A different person who again could not put me in contact with anybody who could help, but this time I did not have to explain anything. He could see that the error was completely on their side, and he put in another request on my behalf and another hold.
On March 17th, I got a letter thanking me for my correspondence, and telling me that the matter will be resolved in 30 days.
Yesterday I got a certified letter which instructed me to CALL IMMEDIATELY TO PREVENT PROPERTY LOSS, which of course I dutifully did. Yet another person who had no access to my returns. She started to put in another request and I told her that this was unacceptable. She forwarded my call directly onto collections. That person took my story, was again not in a position to access my tax returns but checked with her supervisor and again put a 45 day hold on collections and this time made a request that I be contacted by a Taxpayer advocate, which should occur in the next 7 business days. When that occurs, I am prepared to fax that person documentation of all of the information mentioned above.
